As part of our efforts to make your Quidplayer experience as user-friendly and enjoyable as possible, we may collect and use certain information you provide to us. This Privacy and Security Policy addresses the collection and use of User Information (as defined below) that Quidplayer may gather during your Quidplayer experience, including when you interact with the Quidplayer Website and the Quidplayer Service (as defined in the Terms of Service (http://www.quidplayer.com/policies/terms_of_service)).

Please review the entire policy to learn the types of User Information Quidplayer gathers, how Quidplayer uses that User Information, what User Information is disclosed and to what third parties, and how Quidplayer safeguards your User Information. Please also check back periodically as this Privacy and Security Policy may change from time to time without notice, and the information Quidplayer gathers is and will be subject to the Privacy and Security Policy in effect at the time the information is gathered. This Privacy and Security Policy applies to the Quidplayer Website and the Quidplayer Service only. This Privacy and Security Policy does not apply to any websites managed, maintained, and/hosted by third parties not directly affiliated with Quidplayer that you may visit, e.g., via a link on the Quidplayer Website or on a website maintained by any third party. Quidplayer does not control the privacy policies of other websites to which we may provide hyperlinks. We encourage you to learn more about the online privacy and data security policies of third party websites directly from such third parties, as their policies may differ from Quidplayer’s.

By submitting your information to us and by using the Quidplayer Website and the Quidplayer Service, Quidplayer will assume that you have read, understood, and consent to this Privacy and Security Policy and Quidplayer’s Terms of Service, together with all amendments, addenda, and licenses, and all Quidplayer rules and policies (collectively, the “Agreement”), and that you consent to Quidplayer’s use of your information and data as described in the Agreement. If you do not consent, you should not access or use the Quidplayer Website or the Quidplayer Service.

1. Collection of User Information by Quidplayer

Quidplayer may collect user information (“User Information”) in various ways, including (i) obtaining (a) Registration Data (e.g., name, mailing address, e-mail address, and credit card information, as well as age, occupation, and other personally identifiable information) that you may supply when using the Quidplayer Service and (b) other personally identifiable information that you provide when you purchase products or services from Quidplayer, download any content, including Digital Content, request information from Quidplayer, contact Quidplayer via e-mail or telephone, or participate in on-line surveys hosted or supported by Quidplayer, and (ii) obtaining preference tracking information from Quidplayer’s use of cookies, log files, clear gifs, pixel tags, and/or other technology used to monitor your Quidplayer experience (“Movement User Information”). To the extent that any Registration Data or other personally identifiable information is collected, we will use this contact information for business purposes, including, but not limited to, responding to requests for information about Quidplayer and its products and services, providing access to certain products and services, and registering users to the Quidplayer Service.

Quidplayer uses Secure Sockets Layer (SSL) encryption on all Web pages of the Quidplayer Website where personally identifiable information is required to effect a monetary transaction for the purchase of Digital Content. Quidplayer uses SSL encryption and otherwise exercises reasonable care in providing secure transmission of information from your personal computing device to our servers and ensuring the security of your information on our systems. To use the Quidplayer Service or to otherwise make purchases from Quidplayer, you must use an SSL-enabled browser to protect the confidentiality of your personal and credit card information while it is transmitted over the Internet. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we take steps to protect your information, Quidplayer cannot ensure or warrant the security of any information you transmit to us, and you do so entirely at your own risk.

If you use any bulletin board, chat room, or other public communication service or forum offered through the Quidplayer Service or post any information available for viewing by other users, please note that any of the information that you share will be visible to other users, and the information that you make available can be read, used, and collected by other users to send you unsolicited messages outside of the Quidplayer Service. Quidplayer is not responsible for how the personally identifiable information that you decide to share will be used by other users.

As is regular practice on many company websites, Quidplayer’s Website uses cookies and other technologies to help us understand which parts of our Quidplayer Website are more popular and how much time our visitors spend there. A cookie is a small amount of data that is sent to your browser from a Web server and is stored on your computer's hard drive. Cookies allow you to enter your password less frequently during an online session. We may use a separate cookie to track each site's aggregated page views, which tells us which features are most interesting to our users. The cookies that the Quidplayer Website uses do not store personally identifying information about you. Since cookies are now used as industry standard, most Web browsers automatically accept cookies, but you can usually change your browser to decline them. The Quidplayer Website logs Internet Protocol (IP) addresses and browser types (primarily for administration purposes), but we do not match IP addresses to any personally identifiable information. This means that your Quidplayer Website session will be tracked, but you can remain anonymous in the public areas of our Quidplayer Website, and you can browse those areas of our Quidplayer Website without entering any personally identifiable information and therefore remain anonymous during your visit. If you prefer not to enable cookies, you may choose to disable them; however please note that certain features on the Quidplayer Website will not be available to you once cookies are disabled.

When you access Digital Content through the Quidplayer Service, you will be accessing Quidplayer’s central server and not your personal computing device or other hardware. The Quidplayer Service will not at any time expose any files or personal information on your personal computing device or other hardware to Quidplayer or other third parties or otherwise enable Quidplayer or any other third party to have direct access to any of the files or personal information on your personal computing device or other hardware.

Quidplayer also automatically gathers and stores in log files certain information related to access to and use of Quidplayer Website and the Quidplayer Service. This information includes IP addresses, browser type, Internet Service Provider (ISP), referring/exit pages, clickstream data, operating system, and date/time stamp. We may use this information to administer the Quidplayer Website and the Quidplayer Service, track movements around the Quidplayer Website, analyze trends, and gather demographic information. Quidplayer will not use any of this information to market directly to users. Further, in some of our e-mail messages, Quidplayer may use a “click-through URL” linked to content on the Quidplayer Website. When a user clicks onto one of these URLs, the user will pass through our Web server before arriving at the destination Web page. Quidplayer tracks this click-through data to help us determine user interest in this subject matter and measure the effectiveness of these user communications. You can avoid being tracked in this way by not clicking text or graphic links in e-mails from Quidplayer.

Finally, we may use clear gifs or pixel tags, which are tiny graphic images, in order: (i) to advise us of what parts of the Quidplayer Website users have visited, (ii) to measure the effectiveness of any searches users perform on our Quidplayer Website, and (iii) to enable us to send e-mails in a format that users can read and tell us whether such e-mails have been opened in order to ensure us that we are sending messages that are of interest to our users.

2. Use of User Information by Quidplayer

The User Information that Quidplayer collects may be added to our databases and used for future communications regarding site updates and new products and services. The User Information that Quidplayer collects from cookies and browser identification provides demographic data about our users in the aggregate that we use to improve our service. Personally identifiable information included in User Information, including any Registration Data, may also be used for marketing and promotional purposes, for a statistical analysis of users’ behavior, for product development, for content improvement, or to customize the content and layout of our Quidplayer Website.

In addition, Quidplayer will, on occasion, send e-mails to you about our services or third party products. If you do not want to receive e-mail from us, visit the “Opt Out” link at the bottom of any Quidplayer e-mail to remove yourself from continued receipt of e-mail messages or send an e-mail to us at Optout@quidplayer.com.

Remember, as noted above, User Information such as the information that you provide on any bulletin board, chat room, or other public communication service or forum offered through the Quidplayer Service or post in a member profile available for viewing by other users may be used by any user or viewer.

Sharing User Information With Third Parties

Quidplayer’s policy is not to share User Information with third parties other than as specified below, or where you explicitly request us to share your User Information with a third party.

We may share your User Information with third-parties under the following circumstances:

• (a) Affiliated Businesses We Do Not Control
  

  We work closely with certain business partners. Only with your explicit permission will we provide your Registration Data or other personally identifiable information to our business partners so that they can provide service to you. Should you choose to access these services through the Quidplayer Website, we will ask before sharing your information with our business partners. Quidplayer cannot control what our business partners do with your information, including soliciting you in the future or passing your information to other entities. You may avoid having Quidplayer share your information with its business partners by not granting Quidplayer permission to share your information. Not granting Quidplayer permission to share your information with its business partners may limit your access to their services through the Quidplayer Website.

• (b) Business Transfers
  

  As we continue to develop our business, we might sell or buy assets. In such transactions, User Information generally is often one of the transferred business assets. Additionally, in the unlikely event that Quidplayer itself or substantially all of Quidplayer’s assets are acquired, User Information may be one of the transferred assets.

• (c) Protection of Quidplayer and Others
  

  We may release User Information when we believe release is appropriate to comply with the law, including in response to a subpoena served on Quidplayer; to enforce or apply the Agreement, including the Terms of Service and other agreements, rules, and policies; or to protect the rights, property, or safety of Quidplayer, our users, or others. This includes exchanging information with other companies and organizations for fraud protection.

• (d) Aggregate Site Use Information
  

  We may release aggregate User Information (without revealing any personally identifiable information about you) to advertisers and other third parties in order to promote or describe use of Quidplayer, the Quidplayer Website, or the Quidplayer Service.

3. Children’s Privacy

We are committed to protecting the privacy of children. The Quidplayer Website and the Quidplayer Service are not intended or designed to attract children under the age of thirteen (13). Participation in the Quidplayer Service is void where prohibited. Pursuant to the Children’s Online Privacy Protection Act of 1998 (http://www.ftc.gov/ogc/coppa1.htm), all End Users must be at least thirteen (13) years of age to use the Quidplayer Service. The Quidplayer Service is intended solely for End Users who are thirteen (13) years of age or older, and any registration by, use of, or access to the Quidplayer Service by anyone under the age of thirteen (13) is unauthorized, unlicensed, and in violation of the Agreement. By using the Quidplayer Service, you represent and warrant that you are thirteen (13) years of age or older and that you agree to and agree to abide by all of the terms and conditions of the Agreement. If Quidplayer believes that you are under the age of thirteen (13), Quidplayer may, at any time, in its sole discretion, and with or without notice: (i) terminate your access to or use of the Quidplayer Website, the Quidplayer Website Materials, or the Quidplayer Service (or any portion, aspect, or feature of any of the foregoing), or (ii) delete any content or information that you have posted on the Quidplayer Website.
